ALLAHBAD HIGH COURT: GRANTS PRE BAIL SAYING ITS UNUSAUAL FOR A FATHER-IN-LAW TO RAPE ALONG WITH SOMEONE ELSE “IN INDIAN CULTURE”

The FIR in the case was filed by the victim (daughter-in-law) against Khan (father-in-law) and another co-accused Mohammad Haroon. According to the victim, her father-in-law as well as the co-accused visited to her brother's house where she was present and inquired if her brother was there. Furthermore, when the victim stated that her brother was not there, the father-in-law, along with the other person, began assaulting her, and then when the victim attempted to prevent him, he tried to push her onto the bed, and both accused attempted to rape her. The applicant's counsel contended that because another co-accused was granted anticipatory bail by the High Court, he is also obligated to anticipatory bail on the grounds of parity.
