Procedure To Be Adhered To Properly, Provided For The SC/ST Certificates: Gujarat High Court

Village Panchayat President of G.Kallupatti Village, who belongs to a Hindu Kuravan Community which is a Scheduled Caste community, filed a petition in the Madras High Court because she was issued a caste certificate but later a show-cause notice was issued against her to conduct an inquiry to ascertain her community status. The respondent stated after the inquiry that the petitioner belongs to the Hindu Uppiliyar community (backward class community). The petitioner contends that the procedures, laid down by the Supreme Court in Kumari Madhuri Patil and another V. Additional Commissioner, Tribal Development and others, were not followed properly by the respondent. The Supreme Court in the above case directed that a District Level Vigilance Committee at District Level and State Level Scrutiny Committee must be constituted to look into the matters of the genuineness of the community certificates of Schedule Castes and Scheduled Tribes. The petitioner also contended that it was concluded by the District Collector that no one in the village belongs to the Hindu Kuravan community but the petitioner has knowledge of people who have received such community certificates. The Court observed that indeed the order of the District Collector was not sustainable and hence the matter was passed back to the District Level Vigilance Committee to look into the matter and pass an appropriate order.
