The petitioner is the father of Sridhar, who was studying in the CNMS Sivakami Matriculation Higher Secondary School in class 10 during the academic year 2019-20. Considering the Covid-19 Pandemic situation, the Government took a policy decision to declare as “passed” all the 10th standard students. But in the case, the school did not submit the name of Sridhar while submitting the list of candidates. The reason stated for this was his lack of attendance.
As a result of this, Sridhar did not get the advantage of the policy decision of the Government
The court noted in the order that the children studying in Schools were facing a new challenge, wherein, they had been asked to attend the classes, which were conducted online. The court carefully examined the said Government order and found that the only requirement that needs to be satisfied was that the concerned students must be enrolled with the school so as to be passed, which the petitioner’s child satisfied.
“The Government order does not anywhere stipulate that the benefit will accrue to a student only if he fulfils the attendance requirement”, says the court order. The court ordered the The Director of Government Examinations to declare the son of the petitioner, who is in the nominal roll of the 6th respondent school, to have passed in the 10th standard examination for the academic year 2020-2021 within 2 weeks.
