DELHI HIGH COURT NOTIFIES THAT NEW NOMENCLATURE RELATING TO IPR DISPUTES SHOULD COME INTO FORCE IMME

The Delhi High Court has established an Intellectual Property rights Division to deal with intellectual property right cases. The Division shall deal with original proceedings, Writ Petitions (Civil), CMM, RFA, FAO on Intellectual Property Rights disputes, except those required to be dealt with by the Division bench. As stated in the press note, such a move is welcomed because it shall definitively alleviate the problem of increasing cases, time constraint and the delay in relegating work. Consequently, “This has been done in order to avoid multiplicity of proceedings and to avoid possibility of conflicting decisions with respect to matters relating to the same trademarks, patents, design etc.," the Press Note reads. The office order issued on Wednesday by the Registrar General states that the existing nomenclature of WP-C will be replaced by WP (C)-IPD. Similarly Civil Misc. (Main) will now be replaced with Civil Misc. (Main)-IPD for dealing with IPR related matters. Many other similar changes are now to be adopted. The Intellectual Property Rights Division as recently established by the Delhi High Court constituted based on the committee's recommendations constituted by Chief Justice D.N.Patel and composed of Hon'ble Ms. Justice Prathiba M. Singh and Hon'ble Mr. Justice Sanjeev Narula. The committee was formed to help streamline the large number of cases relating to Intellectual Property Rights.
