Abu Salem,a convict in 1993 Mumbai serial blasts case was extradited from Portugal on 11 November,2005 after a prolonged legal battle.Salem files a petition saying his sentence cannot exceed 25 years as per assurance given by India to Portugal for his extradition in 2002.Supreme Court agreed his petition and refused to commute his sentence.However,it says in terms of national commitment to Portugal the centre after completion of 25 years can advice president to exercise his discretionary powers under Article 72 of the Constitution of India for remission of his sentence,A bench of Justice S K Kaul and M.M.Sundresh said the Central Government is to bound to advise.Furthermore, necessary papers shall be sent within one month of completion of 25 years.In fact, Government can itself exercise power of remission under CrPC within one month upon Completion of sentence.On 25 February,2015 a special TADA court had awarded life imprisonment to Salem in another muder of Mumbai based builder Pradeep Jain in 1995 along with his driver Mehndi Hassan.
