MLAs alleged Adhikari told,he would send IncomeTax officials to their house to implicate false case

Calcutta High Court directed that a notice by police to leader of opposition Suvendu Adhikari on complaint by 4MLAs that he threatened them to be kept in abeyance till next hearing.A petition was filed quashing proceedings against Adhikari,his counsel before the court that MLAs Krishna Kalyani, Biswajit Das,Tanmoy Ghosh and Somen Roy were elected on BJP ticket and later shifted to Trinamool Congress violating law of defection.Justice Bibek Chaudhuri ordered till the final hearing on August 2 operation of notice under Sec-41A(appearance before police officer)of the CrPC issued by the investigation officer of the case on July 1 shall be kept in abeyance.The MLAs alleged that Adhikari told them he would send IncomeTax Department officials to their house to implicate false cases and also threatened to kill them by engaging goons.The threat was made after they did leave house along with leader of opposition during debate in budget session.A submission received by court that secretary of assembly sent representation to officer in charge of Hare Street police station of Kolkata Police requesting him to do needful considering gravity of the offence.Police registered criminal case on basis of representation under Sec-341(wrongful restraint),166(public servant disobeying law),189(threat or injury to public servant) and 506(criminal intimation) of IPC.Rajdeep Majumder counsel of Adhikari argued that a false case is being registered by police only to harass the petitioner,he stated that conduct of member inside House during session cannot be questioned by penal provisions of IPC or other statute.
